Terms of Use

Этот документ доступен на английском и испанском языках.
1. Ownership
This document sets out the general terms of use of the GLOSSY application (the “Application”), available on iOS, Android and desktop, through the glossy.day website and as an extension for the Google Chrome browser, owned by Mr Marc Morales Linares, self-employed professional (autónomo), Spanish tax ID (NIF) 49819232J, with address for notices at Carrer de Floridablanca, 68, 08015 Barcelona, Spain (the “Owner”). Contact email: support@glossy.day.
Registering for and using the Application requires the user’s prior acceptance of the terms of use in force.
The Owner may amend these terms. Changes to these terms, to prices or to subscription plans will be communicated to the User reasonably in advance of taking effect, by email or through a notice in the Application, so that the User can cancel their subscription before they are affected if they do not agree. Price changes will not apply to a subscription period already paid for. Changes to the Application’s features are governed by clause 15.
Downloading and using the Application makes the person a user of it (the “User”) and implies that they have read, understood and accepted all the terms and conditions in this document. If you do not accept these terms, you must not register for, access or use the Application.
2. The service and its features
GLOSSY is a language-learning application built on the “comprehensible input” method. It helps the User improve their language skills by reading books, articles and other content suited to their level, doing writing exercises, practising spoken and/or written conversation, and practising pronunciation. The Application currently offers twelve (12) languages.
The browser extension lets the User look up the meaning of words on web pages and in video subtitles, in the language they are learning, and save them to their GLOSSY vocabulary. It requires a GLOSSY account and may require the Premium plan.
The Application includes certain features based on artificial intelligence, in particular: (i) a conversational assistant with which the User can practise the chosen language; (ii) translation, correction and generation of personalised reading content; and (iii) automatic assessment of the User’s pronunciation. These features are provided using the infrastructure of third-party providers (OpenRouter and Microsoft Azure), through which the User interactions needed for each of them are processed.
For pronunciation practice, the Application records the User’s voice for the sole purpose of assessing it at the time of the exercise; the recording is not kept or stored once the assessment is complete.
Additionally and optionally, the User may expressly authorise the Application to access, read-only, the list of YouTube channels they subscribe to in their Google account, in order to add them as content sources in the Application. This authorisation can be revoked at any time from the User’s own Google account, and refusing it does not prevent access to the rest of the Application’s features.
3. Minimum age
The User must be eighteen (18) years of age or older to register for, access and use the Application. The reason is that the Application gives access to internet content that the User imports or chooses (news, YouTube videos, books), whose nature the Owner cannot guarantee and which may not be suitable for minors. The Application applies an age check at sign-up. The Owner may at any time ask the User for documentation proving their age, and may close the account of a User who refuses to provide it or turns out to be under eighteen.
4. Access plans: free and Premium
GLOSSY offers two access plans:
- Free version: open access, with limited features compared with the Premium version.
- Premium version: a paid monthly or annual subscription giving access to all of the Application’s features.
Purchasing Premium requires first registering a user account and making the corresponding payment.
5. Purchase and payment methods
The User may purchase the Premium subscription through either of the following:
- Google Play Store or Apple App Store (mobile subscription): payment is processed entirely through those platforms’ billing systems and is subject to their own terms of purchase, billing, automatic renewal, cancellation and refund. The Owner uses the RevenueCat service to sync the subscription status (new subscription, renewal, cancellation, refund and trial end) with the User’s account in the Application; neither the Owner nor RevenueCat ever has access to the payment method used, which is handled entirely by the relevant store.
- The glossy.day website (web subscription): payment is processed through Stripe, which acts as merchant of record for the sale through its Link service, the name the buyer sees at checkout, on receipts and on their bank statement. Stripe is therefore the entity that formally sells the Premium licence to the User, in its own name, and is responsible for invoicing, collecting payment, applying the taxes due in the User’s jurisdiction and handling any payment issue. Card or other payment details never pass through the Owner: the User enters them directly on the page hosted by Stripe.
Where the subscription includes a free trial, this will be shown before purchase, together with the price that will be charged when the trial ends and the date of the first charge. The trial is granted once per account.
6. Automatic renewal and cancellation
Unless the User cancels with the notice required by the relevant payment platform, the Premium subscription renews automatically for successive periods of the same length as the one originally purchased (monthly or annual), at the price in force at the time, subject to clause 1 on advance notice of price changes. Cancellation must be done from the User’s account settings on the platform where they purchased the subscription (Google Play, App Store) or, for subscriptions purchased on glossy.day, from Stripe’s customer portal or the User’s Link account. Cancellation takes effect at the end of the period already paid for, and the User keeps Premium access until then. If the User cancels during the free trial, they will not be charged.
7. Right of withdrawal
A User who is a consumer has fourteen (14) calendar days from purchasing the subscription to withdraw from it, without giving any reason.
- If they withdraw during the free trial, they will not be charged.
- If they withdraw after the first charge and within those fourteen days, the full amount charged will be refunded, using the same payment method, within fourteen (14) days of notifying the withdrawal.
To exercise this right, the User can cancel the subscription as described in clause 6 and notify their decision to withdraw by email to support@glossy.day, stating their account’s email address. For subscriptions purchased through Google Play or the App Store, the refund is processed through the relevant store under its own terms.
8. Affiliate programme
The Owner runs an affiliate programme managed through Affonso, which attributes a purchase to the affiliate whose link brought the User and, where applicable, automatically applies the associated discount. This attribution uses a tracking cookie that is only set, after notice and express consent, when the User arrives at the site through an affiliate link; if the User declines, the notice is not shown again and they are not tracked in any way. Other users, who do not arrive through an affiliate link, see no cookie notice for this programme, because no cookie is set for them. Details are in the Cookie Policy.
9. Intellectual property
The Application is a work made up of various integrated and inseparable elements (text, illustrations, reading content, exercises, software, etc.), whose intellectual property rights belong to the Owner, except for materials obtained under licence, authorisation or consent from third parties.
The Owner and third-party licensors retain at all times the intellectual property rights in the Application and its components, granting only a right of use over them. Any right not expressly granted is reserved to the Owner and its licensors.
10. User rights in the content they create
The User is the sole owner of the intellectual property rights in the content they create while using the Application (including writing exercises). However, when the User shares or submits such content through the Application, they grant the Owner a non-exclusive, transferable, royalty-free licence to store, process and use it for the purpose of providing the service, including sending it, where appropriate, to the artificial intelligence providers used for the correction, conversation, translation and pronunciation features.
11. Use of artificial intelligence features
The conversation, correction, content generation and pronunciation assessment features are provided through artificial intelligence systems whose technological infrastructure is supplied by third parties (OpenRouter and Microsoft Azure). The User acknowledges and accepts that:
- They are interacting with an automated system and not with a natural person, in accordance with Article 50 of Regulation (EU) 2024/1689 (Artificial Intelligence Act).
- Responses and assessments generated by AI are for educational and language-practice purposes only, may contain inaccuracies or errors, and never constitute advice of any kind.
- For pronunciation practice specifically, their voice is recorded only to be assessed at the time of the exercise and is not stored.
- The Owner does not guarantee the continuous availability of these features, as they depend on the infrastructure of third-party providers.
- Using these features to enter or generate content that is unlawful, offensive, discriminatory or contrary to these terms is prohibited; the Owner may suspend access to them, or to the Application as a whole, in the event of misuse.
12. User obligations
The User undertakes to use the Application and all its content in accordance with the law, morality, public order and these terms. In particular, the User undertakes:
- Not to use the Application for unlawful or criminal activities, activities that infringe the rights of third parties, or activities that breach intellectual and industrial property law.
- Not to transmit or spread through the Application, including its AI features, content contrary to the law, morality, public order or these terms.
- Not to generate, share or upload content that is illegal, misleading, discriminatory, violent, obscene, xenophobic or defamatory.
- Not to introduce viruses or malicious code, or carry out activities that could disrupt the proper operation of the Application.
- Not to collect or use other users’ personal data without their express consent or in breach of the GDPR.
Breach of any of these rules entitles the Owner to close the User’s account immediately and to remove any content they have created that is contrary to law.
13. Limitation of liability
The Owner does not guarantee that faults or errors hindering the service will not occur while using the Application. Provided the Owner has acted with due diligence, it accepts no liability for: losses not caused by a breach by the Owner; losses not reasonably foreseeable by either party; content spread by other users; third-party content that the User imports or views through the Application; or the accuracy, availability or outcome of responses or assessments generated by artificial intelligence systems, whose infrastructure depends on third-party providers outside the Owner’s control.
The Owner likewise accepts no liability for payment handling carried out by Stripe, Google Play or the Apple App Store; those platforms are responsible for resolving any issue relating to billing, payment or refund of the subscription, without prejudice to clause 7.
14. Personal data protection
Any personal information or data the User provides through the Application will be processed as set out in GLOSSY’s Privacy Policy, which details in particular the providers used for each feature, the data they receive and the Owner’s commitments regarding advertising, data sharing and User tracking.
15. Changes to the service
The Owner reserves the right to make, without prior notice, whatever changes it considers appropriate for the proper operation of the Application, including changing, removing or adding content and features, and the way they are presented. Changes to these terms, to prices or to subscription plans are not governed by this clause but by clause 1, and will be communicated in advance.
16. Legal action
If the User breaches these terms, the Owner may bring whatever legal action is appropriate and claim any compensation due.
17. Governing law and jurisdiction
These terms are governed by Spanish law. Without prejudice to any mandatory venue to which the User may be entitled as a consumer, any dispute will be submitted to the courts that have jurisdiction under the applicable law.
